Security Deposit. A security deposit preauthorization of $400.00 is required to rent the equipment and is due at the time of equipment checkout. Unless prior arrangements are made to pay via different means, Triple J shall be authorized to charge Renter’s credit card on file for the full amount of the security deposit, along with any other costs incurred by Renter in accordance with the terms hereof. Any unused portion of the security deposit preauthorization will be released after the completion of the rental period, provided no damage to the equipment is found, and no additional charges have accrued as outlined under this Agreement. If damage is caused by Renter during the rental period, Renter authorizes Triple J to charge the credit card on file for the full amount of any such damages, including repair costs and to then notify Renter of the same. Renter understands that all damages will be repaired by Triple J’s authorized mechanics and/or repairmen; and no repairs will be allowed by Renter or others. Renter understands that Renter is responsible for all damages, even if they are above the amount of the initial security deposit.

Reservation Deposit/Cancellation or No-Show Policy. 50% of the booking total is required at the time of booking. Renter hereby authorizes Triple J to charge Renter’s credit card on file the balance of the booking chanrges on the morning of vessel delivery. Renter understands that when the equipment is reserved, it is no longer available for other customers and therefore, Triple J cannot commit the equipment to another customer during the reserved dates/times. Consequently, in the event Renter cancels, changes dates, shortens the rental period, or in any other way seeks to change the rental period, the entire rental total shall still be due and payable.

Authorized Users/Operation of Equipment. The equipment may be operatedonly by the Renter and other qualified operators named in this Agreement. Renter agrees not to permit any other person to operate the equipment. Renter certifies that Renter is 21 years of age or older and any other named operators are 21 years of age or older. Renter warrants that Renter is a qualified operator of said equipment. Renter will not allow any person who is not qualified
to operate the equipment. Renter undertakes all financial responsibility regardless of who is operating the equipment. Renter will not operate the equipment, or permit anyone to operate the equipment, while under the influence of alcohol or drugs. RENTER SHALL BE RESPONSIBLE FOR THE OPERATION OF THE EQUIPMENT WITHIN ALL LOCAL, STATE, AND FEDERAL LAWS AND REGULATIONS AND RENTER IS SOLELY RESPONSIBLE FOR OBTAINING KNOWLEDGE AND UNDERSTANDING REGARDING ALL SUCH LAWS AND REGULATIONS.

Life Jackets. NO LIFE JACKETS ARE SUPPLIED WITH THE EQUIPMENT. RENTER IS RESPONSIBLE FOR OBTAINING AND HAVING ON THE BOAT ALL LIFE JACKETS AS REQUIRED BY LOCAL, STATE AND FEDERAL LAWS.

No Grilling or Cooking. All grilling and cooking must be done on land away from the boat.

No Pets. Pets ARE NOT allowed on the equipment, with the exception of certified service dogs. Proof of certification required.

No Skiing, Tubing or Pulling of Persons or any other floatation devises. Pulling of any skiers, tubers or other flotations devises is strictly prohibited.

No Smoking/Fireworks/Burning Materials. There shall be no smoking permitted at any time in the equipment. Nor shall Renter at any time light off any fireworks while on or near the equipment.

Indemnification. Renter agrees to indemnify Triple J and to save Triple J harmless from and against any and all claims, losses, actions, damages, liabilities and expenses in connection with loss of life, personal injury and/or damage to the property arising from or out of any occurrence in, upon or while using the equipment. In case Triple J shall, without fault on its part, be made a party to any litigation commenced by or against Renter, than Renter shall protect and hold Triple J harmless and shall pay all costs, expenses and reasonable attorney’s fees incurred or paid by Triple J in connection with such claim or litigation.

Weather Conditions. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather.

Attorneys’ Fees/Costs. In any lawsuit arising out of this Agreement, Triple J shall be entitled to an award of Triple J’s actual attorneys’ fees and costs incurred in any said proceeding.

SAFETY PRECAUTIONS. IT IS THE RENTERS’S RESPONSIBILITY TO LEARN ABOUT SAFETY PRECAUTIONS, WARNING SIGNS OF WATER CONDITIONS, AND SAFETY PROCEDURES CONCERNING SWIMMING IN OR BEING AROUND A LAKE. RENTER AGREES TO HAVE RESPONSIBLE ADULT(S) SUPERVISING MINORS WHILE THEY SWIM IN A LAKE. RENTER IS HEREBY NOTIFIED THAT THE LAKE CAN BE DANGEROUS AND RENTER ACCEPTS FULLY THE RISKS INVOLVED IN ENGAGING IN LAKE ACTIVITIES (I.E. SWIMMING, BOATING, ETC.).

Cleaning Fees. Renter understands that if the equipment is not as clean upon return as it was upon checkout, that Renter will be charged a cleaning fee of $100.00. Renter hereby authorizes Triple J to charge Renter’s credit care on file for any cleaning fee owed by Renter.
